Behind on Your Mortgage? Options Before Foreclosure in Florida

How Florida foreclosure works, your options, and how selling early can protect your equity.

If you are behind on your mortgage or worried about foreclosure, you have more options than you may think, and acting early protects them. Here is a plain-language overview for Florida homeowners.

Get free, trusted help first. HUD-approved housing counselors give free advice on foreclosure options; you can find one through the U.S. Department of Housing and Urban Development. For legal questions, talk to a Florida attorney or a legal aid office. This guide is general information, not legal advice.

How foreclosure works in Florida

Florida uses judicial foreclosure, which means the lender must file a lawsuit and a court must approve the foreclosure. The process often takes months, and homeowners usually keep ownership until the court sale. If you are served with a lawsuit, do not ignore it: there are deadlines to respond.

Your main options

OptionWhen it may fit
Talk to your lender about a repayment plan, forbearance or loan modificationThe hardship is temporary and you want to keep the home
Sell the home before the foreclosure saleYou have equity. Selling lets you pay off the loan and keep what is left instead of losing it
Short saleYou owe more than the home is worth. The lender agrees to accept less than the full payoff; this needs lender approval and takes time
Deed in lieu of foreclosureThe lender agrees to take the home back instead of foreclosing

Why selling early can protect your equity

Many South Florida homes have gained value over the years. If your home is worth more than you owe, a regular sale on the open market usually gets a much better result than a foreclosure auction. The earlier you start, the more time you have to get a fair price.

Avoid foreclosure rescue scams

  • Never pay an upfront fee to someone who promises to "save" your home.
  • Never sign over your deed to someone who says you can rent it back and buy it later, unless your own attorney has reviewed it.
  • Be careful with anyone who tells you to stop talking to your lender or to send payments to them instead.
